MINUTES OF A REGULAR MEETING

PLANNING AND ZONING COMMISSION

June 26, 2006


 

The Planning and Zoning Commission of the City of Hunters Creek Village, Texas, convened in regular session on June 26, 2006 at 7:30 p.m. in City Hall at #1 Hunters Creek Place, Hunters Creek Village, Texas.

 

The meeting was called to order at 7:30 p.m. by Vice Chairman Don Fizer, and the roll of appointed officers was taken.  The following commissioners present were:  Alice Kilgore, Sandy Timte, and Don Fizer.  Also in attendance were Deborah Loesch, City Secretary, and Cheryl Wilson, City Attorney. 

 

Discussion with possible action to consider approval of the minutes of the March 27, 2006 meeting.

 

A motion was made by Alice Kilgore with a second by Sandy Timte to approve the minutes of the March 27, 2006 as written.  The motion carried unanimously.

 

Discussion and possible action to consider electing a chairman and vice chairman.

 

The Commission was informed that Chairman Plato Pappas was resigning as chairman due to personal reasons.  Therefore a new chairman and vice chairman would need to be elected.  A motion was made by Sandy Timte with a second by Alice Kilgore to nominate Don Fizer as Chairman and David Weaver as Vice Chairman.  The motion carried with voting Aye (2):  Timte and Kilgore and Nay (1):  Fizer.

 

Presentation and discussion of a review of the City’s zoning ordinance regarding amending Sub-Section 7-7, Limitation on Signs, in its entirety, and possible action to adopt a preliminary report regarding proposed amendments and set a date for a public hearing.

 

A motion was made by Alice Kilgore with a second by Sandy Timte to adopt as a preliminary and final report a recommendation that no change in the sign regulations is warranted at this time.  The motion carried unanimously.

 

Presentation and discussion of proposed changes to notice and hearing requirements for amendments to zoning district classifications, boundaries and regulations in Section 17 of Chapter 14 of the Code of Ordinances and possible action to adopt a preliminary report regarding proposed amendments and set a date for a public hearing.

 

The following proposed changes to notice and hearing requirements for amendments to zoning district classifications or boundaries and district regulations were considered.  These changes were being proposed to be consistent with state statutes.

 

Section 17 of Chapter 14 of the Code of Ordinances:

 

Paragraph 2.         Submission to Planning and Zoning Commission. Before taking action on any proposed amendment, supplement, or change to a zoning district classification or boundary or a zoning district regulation, the City Council shall submit the proposed revision to the Planning and Zoning Commission for its recommendation and report.

 

Paragraph 3.         Public Hearing – Planning and Zoning Commission.  Planning and Zoning Commission shall make a preliminary report and hold public hearings thereon before submitting its final report. Written notice of all public hearings before the Planning and Zoning Commission on proposed changes to a zoning district classification or boundary shall be sent to owners of real property lying within 200 feet of the property on which the change in classification or boundary is proposed, such notice to be given not less than ten (10) days before the date set for hearing to all such owners who have rendered their said property for City taxes as the ownership appears on the last approved City tax rolls. Such notice may be served by depositing the same, properly addressed and postage paid, in the City post office

 

Paragraph 4.         Public Hearing – City Council.  After receipt of the final report and recommendation of the Planning and Zoning Commission, a public hearing shall be held by City Council before adopting any amendment, supplement or change to a zoning district classification or boundary or district regulation.  Notice of such hearing shall be published one time in a newspaper of general circulation in the City giving the time, date and place of such hearing  and describing in reasonable detail the proposed amendment, supplement or change.  Such notice shall be published at least fifteen (15) days prior to the date of such hearing .  All costs of such publication shall be paid by the person requesting such amendment, supplement or change, if any.

 

A motion was made by Sandy Timte with a second by Alice Kilgore to adopt the proposed changes as presented as the preliminary report.  The motion carried unanimously.

 

A motion was made by Don Fizer with a second by Sandy Timte to set a date and time for a public hearing to be held at the regular meeting in July and consider a final report.  The motion carried unanimously.

 

Adjournment

 

With no further business coming before the Commission, a motion as made by Sandy Timte with a second by Alice Kilgore to adjourn the meeting.  The motion was unanimous.  The meeting adjourned at 8:10 p.m.
