CITY OF HUNTERS CREEK VILLAGE, TEXAS

MINUTES OF CITY COUNCIL MEETING

DECEMBER 19, 2005 

The City Council of the City of Hunters Creek Village, Texas convened in a special session at 7:30 p.m. on Monday, December 19, 2005, at City Hall, #1 Hunters Creek Place, Hunters Creek Village, Texas.

With a quorum of the Council Members present, Mayor Reichek called the session to order at 7:30 p.m.  It was noted that Councilmember Burck was not in attendance.  

A.        Discussion and possible action to receive a final report from the Planning and Zoning Commission on proposed zoning amendments to: (1) amend Chapter 14, Sub-Section 6-7i to permit a fence or wall along or behind the front building line, regardless of where the residence is located on the lot and providing for the type of fencing material allowed; (2) amend Chapter 14, Sub-Section 6-5(3) (iv) and (v) to delete regulations requiring the opening of automobile shelters (garages) that face the side line of a lot to be situated or screened so that no part of the opening is visible from the front street in a line of view that forms an angle, measured from any point on the front street line to any point in such opening, that is greater than 45 degrees and such screening providing a solid visual barrier; (3) amend Chapter 14, Section 19.5 to amend the definition of “height of building” and to amend Sub-Sections 6-3 and 7-2 to provide that the maximum height of buildings and structures, with certain limitations and exclusions, is 35 feet, unless the lot is one acre or more in size on lots one acre or more in size, a maximum height of 38’ will be allowed, but an additional 5’ of side yard and rear yard set backs will be required; and (4) amend Chapter 14, Sub-Section 9-2 to establish the minimum required yards and maximum lot coverage for non-conforming lots and to establish the maximum height of buildings located on non-conforming lots. 

            A motion was made by Councilmember Stark with a second by Councilmember Cokinos to receive and accept the final report and recommendation of the Planning and Zoning Commission dated November 28, 2005 on the above captioned items.  The motion carried unanimously with Council voting four (4) for and none (0) opposed.

The Final Report is referred to by reference only.  A copy of the report is on file in the City Secretary’s Office.
 

B.        PUBLIC HEARINGS.

Public hearings will be held for the purpose of receiving testimony for and against on each of the following proposals to amend Chapter 14 of the Code of Ordinances, the same being the City’s Zoning Ordinance: (1) amending Section 19.5 to amend the definition of “height of building” and to amend Sub-Section 6-3 and 7-2 related to height regulations;  (2) amending Sub-Section 9-2 to establish the required yards and maximum lot coverage for non-conforming lots and to establish the maximum height of buildings located on non-conforming lots; (3) amending Sub-Section 6-5(3) (iv) and (v) to delete regulations requiring the opening of automobile shelters (garages) that face the side line of a lot to be situated or screened so that no part of the opening is visible from the front street in a line of view that forms an angle, measured from any point on the front street line to any point in such opening, that is greater than 45 degrees and such screening providing a solid visual barrier; and (4) amending Sub-Section 6-7i. to permit a fence or wall along or behind the front building line, regardless of where the residence is located on the lot and providing for the type of fencing material allowed. 

            Mayor Reichek opened the public hearings for comments for and against the proposed amendments.

1.                  Amending Section 19.5 to amend the definition of “height of building” and to amend Sub-Section 6-3 and 7-2 related to height regulations.  There were no comments received.

2.                  Amending Sub-Section 9-2 to establish the required yards and maximum lot coverage for non-conforming lots and to establish the maximum height of buildings located on non-conforming lots.  There were no comments received.

3.                  Amending Sub-Section 6-5(3) (iv) and (v) to delete regulations requiring the opening of automobile shelters (garages) that face the side line of a lot to be situated or screened so that no part of the opening is visible from the front street in a line of view that forms an angle, measured from any point on the front street line to any point in such opening, that is greater than 45 degrees and such screening providing a solid visual barrier.  There were no comments received.

4.                  Amending Sub-Section 6-7i. to permit a fence or wall along or behind the front building line, regardless of where the residence is located on the lot and providing for the type of fencing material allowed.  Ken Spalding spoke in regard to allowing wood as an approved fencing material.

Hearing no further comments, the public hearings were closed.

ADJOURN OPEN MEETING

A motion was made by Councilmember Stark with a second by Councilmember Casper to adjourn the meeting.  The motion carried unanimously.  The meeting was adjourned at 7:40 p.m.
